Terms of treatment

The German version of this text is the authoritative one. This translation is provided for convenience.
§ 1 Scope
These terms apply to all treatment contracts between Reha-Punkt Findorff — Praxis für Physiotherapie, Inh. Michael Ahrens e.K., Hemmstraße 148, 28215 Bremen (the practice) and its patients, whether treatment is delivered on prescription or as a self-paying patient.
Deviating terms of the patient do not become part of the contract unless the practice has agreed to them in writing.
§ 2 How the contract comes about
A treatment contract under § 630 a BGB comes about when the practice confirms an appointment and the patient attends it. Booking an appointment through Doctolib, by telephone or through the call-back form on this website is a request; the contract does not come about until treatment begins.
This website does not sell anything. No goods or services can be bought online here, which is why there is no right of withdrawal to notify.
§ 3 Scope of treatment
Where treatment is delivered on a Heilmittelverordnung, its content, frequency and quantity follow the prescription and the Heilmittel-Richtlinie. The practice may not deviate from the prescription.
The practice owes proper treatment in accordance with the recognised professional standard at the time (§ 630 a (2) BGB). It does not owe a particular outcome, and no statement on this website or in the practice is to be understood as a promise of recovery or of freedom from pain.
Diagnosis is a matter for the treating doctor. The practice does not diagnose and does not give medical advice about whether a treatment is indicated.
§ 4 Duties of the patient
The patient hands over the prescription, the insurance card and, where applicable, the exemption certificate at or before the first appointment.
The patient informs the practice of illnesses, injuries, pregnancies, implants and medication that could be relevant to the treatment, and reports any change during the course of treatment.
The patient reports pain or unusual reactions during or after a treatment without delay.
§ 5 Prices, co-payment and payment
The prices on the price list of this website apply to self-paying and privately insured patients. They are guide prices; the invoice follows the treatments actually delivered.
Patients insured with a statutory health insurer pay the statutory co-payment under § 61 SGB V: €10 per prescription plus 10 % of the amount the insurer settles for each treatment. It is due at the first appointment of a prescription. Patients under 18 and adults holding a valid exemption certificate are not charged it.
The Zuzahlung calculator on this website is a guide. It is not an invoice and it does not bind the health insurer; the binding amount is the one the insurer settles against the prescription.
Payment is by card or in cash directly at the practice. Invoices for private patients are payable within fourteen days without deduction.
§ 6 Cancellation and missed appointments
Appointments can be cancelled free of charge up to 24 hours in advance, by telephone, by email or through Doctolib.
If an appointment is cancelled later than that or not attended at all, the practice may invoice the reserved time at the self-pay rate of the treatment concerned. Statutory and private health insurers do not reimburse this amount; it is charged to the patient.
No charge is made if the patient shows that the appointment could not be attended for a reason they were not responsible for — sudden illness, for instance.
§ 7 Prescription rules
Treatment on a prescription must begin within 28 days of the date the prescription was issued, otherwise it expires (Heilmittel-Richtlinie).
If treatment is interrupted for more than 14 days without a medical reason, the prescription has to be closed and a new one obtained. The practice will point this out where it can, but the responsibility rests with the patient.
The practice cannot change, extend or reissue a prescription. That is a matter for the prescribing doctor.
§ 8 Liability
The practice is liable without limitation for injury to life, body or health caused by a negligent or intentional breach of duty, and for other damage caused intentionally or by gross negligence.
For slight negligence the practice is liable only where an obligation is breached whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the patient may regularly rely; liability is then limited to the damage typically foreseeable for this kind of contract.
Liability under the Product Liability Act remains unaffected.
§ 9 Data protection and confidentiality
Everyone working at the practice is bound by medical confidentiality under § 203 StGB. Personal data is processed as set out in the privacy policy of this website and in the patient information handed over at the first appointment.
§ 10 Final provisions
German law applies. If the patient is a consumer, mandatory consumer protection provisions of the state in which they are habitually resident remain unaffected.
Should individual provisions of these terms be or become invalid, the validity of the remaining provisions is unaffected.
The practice is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
